Section 1. General Terms
Restrictions on TransferWithout first obtaining the express written consent of ‘IT BEST-PATH’, you may not assign your rights and obligations under this Agreement, or redistribute, share, encumber, sell, rent, lease, sublicense, or transfer your rights to the Software Product.
Restrictions on UseYou may not decompile, “reverse-engineer,” disassemble, or otherwise attempt to derive the source code for the Software Product.
Restrictions on AlterationYou may not modify the Software Product or create any derivative work of the Software Product or its accompanying documentation. Derivative works include, but are not limited to, translations. You may not alter any files that may be downloaded as a result of accessing the Software Product. This Agreement does not permit the sharing or use of ‘IT BEST-PATH’ materials in a classroom setting or otherwise.
Disclaimer of Warranties and Limitation of LiabilityUnless otherwise explicitly agreed to in writing by ‘IT BEST-PATH’, ‘IT BEST-PATH’ makes no other warranties, express or implied, in fact or in law, including, but not limited to, any implied warranties of merchantability or fitness for a purpose other than as set forth in this agreement.
‘IT BEST-PATH’ makes no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. ‘IT BEST-PATH’ makes no warranty that the operation of the Software Product will be secure, error-free, or free from interruption. You must determine whether the Software Product sufficiently meets your requirements for security and uninterruptability. You bear sole responsibility and all liability for any loss incurred due to failure of the Software Product to meet your requirements. ‘IT BEST-PATH’ will not, under any circumstances, be responsible or liable for the loss of data on any Computer or Information Storage Device.
Under no circumstances shall ‘IT BEST-PATH’, its Directors, Officers, Employees, or Agents be liable to you or any other party for indirect, consequential, special, incidental, punitive, or exemplary damages of any kind (including lost revenues or profits or loss of business) resulting from this Agreement, or from the furnishing, performance, or use of the Software Product, whether due to a breach of contract, breach of warranty, or the negligence of ‘IT BEST-PATH’ or any other party, even if ‘IT BEST-PATH’ is advised beforehand of the possibility of such damages. To the extent that the applicable jurisdiction limits ‘IT BEST-PATH’’s ability to disclaim any implied warranties, this disclaimer shall be effective to the maximum extent permitted.
Limitation of Remedies and DamagesYour remedy for a breach of this Agreement is the correction or replacement of the Software Product. Selection of whether to correct or replace the Software Product will be at the sole discretion of ‘IT BEST-PATH’. ‘IT BEST-PATH’ reserves the right to substitute a functionally equivalent copy of the Software Product as an update or replacement. If ‘IT BEST-PATH’ is unable to provide a replacement or substitute Software Product or corrections to the Software Product, your sole alternate remedy shall be the termination of a concurrent subscription.
Governing Law, Jurisdiction, and CostsThis Agreement is governed by the laws of Province of British Columbia, without regard to British Columbia’s conflict or choice of law provisions.
SeverabilityIf any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
Member Account SecurityIf any services require you to open an account, you must complete the registration process by providing us with current, complete, and accurate information as prompted by the applicable registration form. You also must choose a password and username. You, the end user, are solely responsible for maintaining the confidentiality of your password and account credentials. Furthermore, you are solely responsible for any and all actions or activities that occur under your account, excluding any breaches of your account that occur within ‘IT BEST-PATH’.
By initiating an ‘IT BEST-PATH’ member account, you agree to notify ‘IT BEST-PATH’ immediately of any unauthorized use of your account or any other breach of security. ‘IT BEST-PATH’ will not be liable for any loss that you incur due to the use of your password or account by any third party, either with or without your consent. However, you may be held liable for losses incurred by ‘IT BEST-PATH’ that result from third party access to your account or password. You may not use anyone else’s account at any time as all member accounts are intended for use by the single intended registrant.
Section 2. End User License Agreement
Subscription and Streaming ProductsEach copy of ‘IT BEST-PATH’ training materials (“the Software Product”) and accompanying documentation is licensed and not sold. This Software Product – including, but not limited to, the Networking Pass, Cloud Pass, IT Essentials Pass, Development Pass, or other streaming subscriptions, training bundles, individual course and video downloads, and workbooks – is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. ‘IT BEST-PATH’ own intellectual property rights in the Software Product. The Licensee’s (“you” or “your”) license to download, stream, use, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (“Agreement”).
License GrantThis Agreement entitles you to view and use the Software Product on one active connection at a time on any compatible device. This Agreement does not permit the downloading of content contained in the Software Product beyond the standard buffer that video players use in the streaming of content. This Agreement does not permit the use of the Software Product on more than one computer or device at any given time, nor may the materials be accessed by more than one user per login credential (see Member Account Security). ‘IT BEST-PATH’ requires a 1-to-1 license-to-user ratio for all materials. A generic email address (such as info@ine.com) cannot be used to create an account with ‘IT BEST-PATH’ or to buy materials.
Section 3. Terms of Use
3a: ‘IT BEST-PATH’ Training Passes and Subscriptions
By starting your ‘IT BEST-PATH’ IT Training Pass membership, you expressly agree that ‘IT BEST-PATH’ is authorized to charge you a membership fee at the current published rate. By subscribing or purchasing a subscription extension you authorize ‘IT BEST-PATH’ to charge your payment method now and again at the beginning of each subsequent renewal period. All subscriptions renew automatically using the payment information you have provided for your account, including periodic credit card updates. When you purchase an ‘IT BEST-PATH’ Training Pass subscription, you acknowledge and agree that ‘IT BEST-PATH’ is authorized to use the payment information provided for the renewal fee and process the fee automatically on your renewal date.
Your subscription to any ‘IT BEST-PATH’ Training Pass will automatically renew at the end of each subscription term unless you cancel your renewal prior to the end of said term. You must cancel your subscription renewal before the scheduled renewal date to avoid auto renewal and the associated renewal fee. To cancel your subscription renewal, login to your account at www.itbestpath.com and select ‘Membership Profile’, located on the top right of the screen. From your profile, select the ‘Subscription’ tab. On the Subscription tab and underneath the subscription listing click the link embedded in ‘Please click here to manage your subscriptions’. On your subscription page, click the ‘Cancel Subscription’ button and the auto-renewal will be canceled.
‘IT BEST-PATH’ Training Passes Payment, Pricing, & Refund Terms
All ‘IT BEST-PATH’ Training Passes subscription fees must be paid via credit card only. Acceptance of any alternate forms of payment for any ‘IT BEST-PATH’ Training Passes are at the sole discretion of ‘IT BEST-PATH’. Discounts and other promotional offers may only be valid for initial term. Special terms may apply to discounted or promotional ‘IT BEST-PATH’ Training Pass purchases. See specific offer for further details. ‘IT BEST-PATH’ may increase subscription fees for a subsequent subscription period at any time and for any reason, provided that ‘IT BEST-PATH’ provides notice at least thirty (30) calendar days prior to the expiration of the subscription. ‘IT BEST-PATH’ may terminate the subscription and these terms if unable to renew the subscription due to any issue with credit card processing, including but not limited to inaccurate or outdated credit card information.
All ‘IT BEST-PATH’ Training Passes subscription fees are final and non-refundable. The ‘IT BEST-PATH’ Training Passes are a subscription service which will renew at the end of each term automatically. Subscription renewal fees for one-year (yearly) plans are eligible for refund up to three (3) days after your INE Training Pass renews, providing your account has not been in use since the renewal date. Requests for refund must be received via email to help@gnconsulting.co.kr. Subscription renewal fees for one-month (monthly) ‘IT BEST-PATH’ Training Pass subscriptions are non-refundable under any circumstances. Consideration beyond the stated terms for refunding all or part of your ‘IT BEST-PATH’ Training Pass Subscription renewal fee is at the sole discretion of ‘IT BEST-PATH’.
3b: Electronic Products
All electronic product purchases and pre-orders, including but not limited to lab workbooks and streaming or downloadable courses, are final, non-refundable, and non-transferable to any third party unless a prior licensing agreement is documented in writing and approved by ‘IT BEST-PATH’. Electronic accounts suspected of being used by any party other than the purchaser or single intended recipient are subject to recoation without prior notice at the complete and sole discretion of ‘IT BEST-PATH’. Accounts suspended in this manner will not be eligible for refund nor store credit for any uses or unused portion of the subscription or materials therein. All electronic products including, but not limited to passwords, dynamic URLs, and watermarks, are subject to copy-protection schemes.
Section 4. Payments, Pricing and Promotions
Purchase Order Payment Terms
We are happy to accept purchase orders. ‘IT BEST-PATH’ provides invoices electronically via email. The ‘IT BEST-PATH’ standard purchase order payment terms are NET 30 from the invoice date unless alternate terms are approved before order fulfillment.
The available payment methods for purchase orders are credit card, check or Wire bank transfer. Payment must be processed in USD or CAD, KRW. ‘IT BEST-PATH’ is not responsible for additional fees/charges your bank imposes for sending a wire payment; payment must be made in full.
Failure to submit payment by indicated Net 30 due date could result in suspension of all associated accounts.
INE does not allow for early payment discounts to be applied to order total; payment is due in full.
A signed quote can be substituted as a Purchase Order and maintains the same above polices.
Price Changes and Refunds
All purchases, including pre-orders, are final and nonrefundable. Product pricing is subject to change without notice. If there is a price drop within 48 hours of your original purchase, you may request a store credit for the price difference, provided your purchase was made at full price. This offer does not apply to any special deals, promotions or discounts you may have already received. This store credit is nontransferable and expires 365 days from the date of the original purchase.
Promotional Offers
Promotional offers may occasionally be available with specified purchases. Promotions cannot be combined with any other discounts, promotions or offers unless otherwise stated. The terms and conditions of any promotional offer are set out in the promotional material for such offer, which may vary from our standard terms and conditions, but remain subject to our End User License Agreement. INE reserves the right to discontinue promotions at any time.
Section 5. Content Terms
Content Updates
‘IT BEST-PATH’ Training Bundles – Customers are entitled to product updates only for courses contained in their original bundle at the time of purchase.
‘IT BEST-PATH’ Subscriptions – Members will always have unlimited access to own membership courses and streaming online products included in their Training Pass of choice. This includes all updates made to these products while a member’s subscription remains active.
Content Disclaimer
While every effort has been made to ensure that all material in our publications are as complete and accurate as possible, the material is presented on an “as is” basis. Neither the authors nor ‘IT BEST-PATH’ assume any liability or responsibility to any person or entity with respect to loss or damages incurred from the information contained in workbooks or within other content.
